Terms and Conditions
TERMS AND CONDITIONS AND LIMITED LICENSE AGREEMENT
Last Revised: August 24, 2026
IMPORTANT – READ CAREFULLY: THIS AGREEMENT IS A LEGAL CONTRACT GOVERNING THE USE OF OUR WEBSITES AND CONTENT
Curiosity Untamed LLC is NOT a 501(c)(3) nonprofit organization you join or volunteer for. Curiosity Untamed LLC is a for-profit company that licenses program curriculum for others to use in their youth and family programming. Any Group, Class, Club, or Troop that uses the Curiosity Untamed, Frontier Girls, or Quest Clubs names in its programming is independently operated and is not a division, branch, partner, joint venturer, or agent of Curiosity Untamed LLC.
Nature of Curiosity Untamed LLC’s Business. Curiosity Untamed LLC’s business is limited to licensing program curriculum and certain trademarks for use in youth and family programming that is independently owned and operated by each Licensee. Curiosity Untamed LLC does not operate, manage, staff, supervise, or provide oversight for any Group, Class, Club, or Troop, and does not provide or require background checks, safety certification, child-protection training, risk-management policies, waiver forms, or insurance for any Licensee, leader, volunteer, or Participant. Selecting, screening, training, and supervising leaders and volunteers; adopting and enforcing safety and child-protection policies; obtaining insurance; and complying with all applicable laws in connection with a Group, Class, Club, or Troop are the sole responsibility of the Licensee who purchases and operates it. This division of responsibility applies regardless of Membership type and is elaborated in Section 3.
This Terms and Conditions and Limited License Agreement (this “Agreement”) governs use of the Websites and Content provided by Curiosity Untamed LLC, a California limited liability company (“Licensor”). A “User” is any person or entity who accesses or uses the Website or Content. A User who purchases or otherwise obtains a Subscription granting a license to use the Content is also a “Licensee.” The Licensor and each Licensee are each referred to as a “Party” and collectively as the “Parties.”
Acceptance of Terms. Licensee agrees to be legally bound by this Agreement and the applicable agreements and policies expressly incorporated into it by reference by checking a box at account creation or checkout, or by providing affirmative acceptance through email communication, confirming that Licensee has read and agrees to the Terms and Conditions and the applicable agreements and policies incorporated by reference. A Licensee’s prior affirmative acceptance of an earlier version of this Agreement remains effective and constitutes affirmative acceptance of this Agreement as subsequently amended in accordance with the Modifications provision below. Curiosity Untamed LLC may, in its discretion or where required by applicable law, require Licensee to affirmatively re-accept an amended Agreement by clickwrap or equivalent acceptance process.
Users who access publicly available portions of the Website or Content without affirmatively accepting this Agreement are not Licensees and are not deemed to have affirmatively accepted the contractual provisions applicable specifically to Licensees. However, use of publicly available Website or Content remains subject to applicable law and to the Website-use restrictions, intellectual-property notices, safety warnings, disclaimers, and other provisions of this Agreement that expressly apply to Users.
Modifications. Curiosity Untamed LLC may modify or revise this Agreement from time to time. For any material change — including changes affecting fees, the liability or indemnification provisions, or the dispute resolution provisions in Section 12.8 — Curiosity Untamed LLC will send direct notice to the email address on file. The notice will identify the effective date of the amended Agreement and provide access to the revised terms.
Unless Curiosity Untamed LLC requires affirmative re-acceptance for a particular change or applicable law requires express affirmative consent, a Licensee who has previously affirmatively accepted this Agreement or an earlier version of this Agreement accepts the amended Agreement by continuing to use the Website or Content on or after the effective date. If Licensee does not agree to the amended Agreement, Licensee must discontinue use of the Website and Content and, where applicable, cancel any active Subscription before the change takes effect.
Non-material changes, such as formatting, contact information, or clarifications that do not narrow Licensee’s rights or expand Licensee’s obligations, may be posted without advance notice, and continued use following posting constitutes acceptance.
If any portion of this Agreement is unacceptable to Licensee, the remedy is to discontinue use of the Website and Content and, where applicable, cancel any active Subscription in accordance with Section 2.3.
Order of Control. This Agreement governs generally. Where an applicable Group, Club, and Troop Membership Agreement or Individual and Family Membership Agreement expressly addresses a matter differently, that applicable Membership Agreement controls as to that matter. Supplemental policies and guidelines incorporated into this Agreement, including the Copyright and Curriculum Usage Policy, Trademark and Brand Usage Guidelines, and Privacy Notice, are subordinate to this Agreement and any applicable Membership Agreement.

2. Membership Subscriptions
Section 2.1 Types of Memberships
“Group/Class Membership” is a limited Subscription granted by Licensor to support organized group instruction. This membership grants a limited license to access and use the Content for group programming only and does not imply employment, agency, partnership, or oversight by Curiosity Untamed LLC. All Groups and Classes are independently operated, and their leaders/instructors and participants are solely responsible for their own actions, activities, safety procedures, and compliance with applicable law. Use of the Content under a Group/Class Membership does not establish any endorsement, affiliation, control, or liability on the part of Curiosity Untamed LLC.
“Family/Homeschool Membership” is a limited, non-transferable Subscription granted by Licensor for use of the Content by all members of a single household for homeschooling, family enrichment, or group participation. Each household is solely responsible for all educational activities, safety procedures, and legal compliance.
“Frontier Girls Family Membership” is a limited, non-transferable Subscription granted by Licensor for use of the Content by all members of a single household. In addition to use for homeschooling, family enrichment and group participation, this membership also includes permission for female members of the household to use the Frontier Girls name and Frontier Girls pin for participation in an organized Frontier Girls Troop or as an individual participant. The Frontier Girls name may only be used in direct connection with the tracking number assigned by Licensor (e.g., “Frontier Girls Troop #123”) and may not be used independently to identify an individual, group, event, or program. This membership does not create any employment, agency, partnership, or supervisory relationship with Curiosity Untamed LLC.
“Frontier Girls Individual Membership” is a limited, non-transferable Subscription granted by Licensor for use of the Content by a single female participant, including permission to use the Frontier Girls name and Frontier Girls pin for participation in an organized Frontier Girls Troop or as an individual. The Frontier Girls name may only be used in direct connection with the tracking number assigned by Licensor and may not be used independently.
“Frontier Girls Troop Membership” is a limited Subscription granted by Licensor to support an organized Frontier Girls Troop. It includes a limited license to use the Frontier Girls name and Frontier Girls pin in connection with Troop activities when accompanied by the assigned tracking number. All branding, signage, communications, and public representations using the Frontier Girls name or branding must include the assigned tracking number.
All Frontier Girls Troops are independently operated, and their leaders and participants are solely responsible for their own actions, activities, safety procedures, and compliance with applicable law.
A Frontier Girls Troop Membership also includes, at no additional cost, a license to concurrently operate a companion Quest Club for participants who are not eligible to use the Frontier Girls name. The Membership may be transferred to an authorized successor leader of the same Troop.
“Monthly Family Membership” is a limited, non-transferable Subscription granted by Licensor for use of the Content by all members of a single household for homeschooling, family enrichment, or group participation, billed monthly rather than annually.
“Quest Club Membership” is a limited Subscription granted by Licensor to support organized instruction within a club format. All Quest Clubs are independently operated, and each Quest Club determines its own name, uniform, and membership policies. Quest Club leaders and participants are solely responsible for their own actions, activities, safety procedures, and compliance with applicable law.

Section 2.1(a) Program Availability Regardless of Sex
The “Frontier Girls” name, logo, and Frontier Girls pin are reserved for use by female participants and Troops operating under the Frontier Girls name. The underlying curriculum is available without regard to sex through Quest Clubs. A Frontier Girls Troop Membership includes, at no additional cost, a license to concurrently operate a companion Quest Club for participants who are not eligible to use the Frontier Girls name. The companion Quest Club may establish its own name, uniform, and membership policies, but may not use the Frontier Girls name, logo, or Frontier Girls pin.
Section 2.1(b) Group, Club, and Troop Membership Agreement
A Group/Class Membership, Frontier Girls Troop Membership, or Quest Club Membership is also subject to the Group, Club, and Troop Membership Agreement. Acceptance of this Agreement also constitutes acceptance of the Group, Club, and Troop Membership Agreement incorporated by reference.
By accepting this Agreement, the person accepting certifies that they are the leader or authorized representative of the Group, Class, Club, or Troop associated with the Membership and have authority to accept the Group, Club, and Troop Membership Agreement on its behalf. The Group, Club, and Troop Membership Agreement is incorporated into this Agreement by reference and remains in effect for as long as the associated Subscription remains active.
Section 2.1(c) Individual and Family Membership Agreement
A Family/Homeschool Membership, Frontier Girls Family Membership, Frontier Girls Individual Membership, Monthly Family Membership, Quest Family Membership, or Quest Individual Membership is also subject to the Individual and Family Membership Agreement. Acceptance of this Agreement also constitutes acceptance of the Individual and Family Membership Agreement incorporated by reference.
The Individual and Family Membership Agreement addresses the independent operation of, and Curiosity Untamed LLC’s lack of insurance, oversight, and dispute-resolution role for, any Group, Class, Club, or Troop that a Licensee or Participant may choose to join. The Individual and Family Membership Agreement is incorporated into this Agreement by reference and remains in effect for as long as the associated Subscription remains active.
Section 2.2 Renewal
Membership Subscriptions renew automatically unless Licensee cancels at least 72 hours before the renewal date in accordance with Section 2.3. Renewals are processed using the payment method on file, at the Subscription price and terms in effect on the date of renewal. Licensor will notify Licensee by email of any change to the Subscription price or renewal terms at least fourteen (14) days before the change takes effect, and, where required by applicable law, will obtain Licensee’s express affirmative consent to updated renewal terms before they take effect.
Section 2.3 Cancelling Automatic Renewal
Licensee may cancel automatic renewal by visiting the Account page on the Website and selecting Subscriptions, then Cancel. Cancellation must be submitted at least seventy-two (72) hours before the scheduled renewal date to ensure that the next automatic payment is cancelled. No further steps or confirmation are required from Licensee after submitting the cancellation. The Content license remains in effect until the end of the paid-for term.
Section 2.4 Cancellations and Refunds
No refunds are offered for Monthly Subscriptions. Annual Membership Subscriptions may be cancelled for a full refund within thirty (30) days of the initial purchase or any annual renewal, less payment gateway fees. No refund is available after the applicable 30-day period, except as provided in Section 7.2 (Termination for Convenience by Licensor). Refunds are issued to the original payment method. Please allow 5–10 business days for a refund to appear on the designated account. Fees resulting from a payment dispute or chargeback are not refundable.
3. Liability
Section 3.1 Independent Operation; No Agency
A Licensee and any Group, Class, Club, or Troop operated by a Licensee are independent from Curiosity Untamed LLC. Neither the Licensee nor its Group, Class, Club, or Troop is a division, branch, partner, joint venturer, or agent of Curiosity Untamed LLC. Volunteers, employees, and other personnel involved in a Licensee’s Group, Class, Club, or Troop are not volunteers, employees, agents, or personnel of Curiosity Untamed LLC. Licensee shall not represent that it is an agent of, or has authority to bind, Curiosity Untamed LLC.
Section 3.2 Insurance and Finances
Licensee acknowledges that Curiosity Untamed LLC does not provide insurance or financial support. Licensee is solely responsible for obtaining and maintaining any insurance it deems necessary and for managing all financial aspects of its Group, Troop, Club, or individual programming, including, but not limited to, banking, dues, community events, and fundraising.
Section 3.3 Licensee’s Responsibility
Licensee is solely responsible for selecting and directing all activities, games, field trips, and instruction; for selecting, maintaining, and operating all equipment, vehicles, facilities, and materials used in connection with the Content; for selecting, training, and supervising all children, parents, employees, and volunteers who participate in Licensee’s Group, Class, Troop, or Club; and for child protection, including the screening, selection, training, and supervision of all volunteers, employees, and other personnel who plan, direct, or carry out Group, Class, Troop, or Club activities or instruction.
Section 3.4 Assumption of Risk and Limitation of Liability
LICENSEE VOLUNTARILY ASSUMES ALL RISKS ASSOCIATED WITH USE OF THE CONTENT, KNOWN OR UNKNOWN, AND ASSUMES RESPONSIBILITY FOR INJURY, LOSS, OR DAMAGE TO PERSONS OR PROPERTY ARISING FROM USE OF THE CONTENT, INCLUDING PHYSICAL OR EMOTIONAL INJURY, ACCIDENTS, ILLNESS, OR PROPERTY DAMAGE ARISING FROM ACTIVITIES, EVENTS, OR EXPERIENCES ASSOCIATED WITH THE CONTENT.
CURIOSITY UNTAMED LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES (COLLECTIVELY, THE “LICENSOR PARTIES”) SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, OR DAMAGE RESULTING FROM USE OF THE CONTENT, EXCEPT TO THE EXTENT CAUSED BY THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF THE LICENSOR PARTIES.
If Licensee is dissatisfied with any portion of the Content or this Agreement, Licensee’s remedy is to discontinue using the Website and Content and, where applicable, cancel any active Subscription.
Section 3.4(a) Public Content and Activities
Public Content and Activities. Publicly available Content, including but not limited to, blog posts, articles, activity suggestions, crafts, recipes, projects, educational activities, outdoor activities, and similar materials, is provided for general educational and informational purposes only. Users are responsible for determining whether an activity is appropriate for their circumstances and for providing appropriate supervision, following applicable safety precautions and manufacturer instructions, and obtaining professional guidance when appropriate. Activities may involve risks of personal injury, property damage, or other harm. To the fullest extent permitted by law, Curiosity Untamed LLC and the Licensor Parties are not responsible for injury, loss, or damage resulting from use of or reliance on publicly available Content, except to the extent liability cannot lawfully be excluded or limited.
Section 3.5 Background Checks and Child Protection
Curiosity Untamed LLC does not provide or require background checks, child protection training, or safety certification for any Licensee or participant. Responsibility for compliance with all applicable laws regarding child protection, supervision, safety, and mandated-reporter requirements rests solely with the Licensee. Licensee is responsible for ensuring that all employees, volunteers, and participants meet any legal or organizational requirements for working with minors. Curiosity Untamed LLC shall not be liable for Licensee’s failure to comply with such requirements.
Section 3.6 Limitation of Liability Cap
The total aggregate liability of Curiosity Untamed LLC and the Licensor Parties, for any claim arising out of or relating to this Agreement or use of the Content, whether in contract, tort, or otherwise, shall not exceed the total fees paid by Licensee to Curiosity Untamed LLC in the twelve (12) months preceding the event giving rise to the claim, except to the extent the claim arises from the gross negligence or willful misconduct of Curiosity Untamed LLC, or to the extent this cap is prohibited by applicable law. This limitation applies to the fullest extent permitted by law.
Section 3.7 Participant Waivers and Parental Consent
When Licensee operates a Group, Class, Club, or Troop involving minors, Licensee is solely responsible for independently preparing or obtaining, and collecting from each minor Participant’s parent or legal guardian, any assumption-of-risk, liability-waiver, emergency-contact, or other consent forms appropriate to Licensee’s own program and jurisdiction. Curiosity Untamed LLC does not provide, review, approve, or endorse any waiver, consent, or risk-management form, and Licensee may not represent that any such form has been supplied, reviewed, or approved by Curiosity Untamed LLC.
Section 3.8 Disputes Between Licensees, Leaders, Participants, or Third Parties
Curiosity Untamed LLC does not manage, monitor, or have access to any Group’s, Class’s, Club’s, or Troop’s finances, dues, fundraising proceeds, or bank accounts. Disputes arising from the operation of a Group, Class, Club, or Troop, including, but not limited to, disputes involving finances, leadership, membership, or program administration, are solely between the parties involved.
To the fullest extent permitted by law, Licensee releases Curiosity Untamed LLC and the Licensor Parties (as defined in Section 3.4) from claims, demands, and damages arising out of or relating to disputes described in this Section 3.8, to the extent such claims belong to Licensee.
This Section does not limit Curiosity Untamed LLC’s discretion to take action under Section 4 (Rules of Conduct), including suspending or terminating an account for a violation of this Agreement. Curiosity Untamed LLC is under no obligation to investigate, mediate, adjudicate, or otherwise resolve any such dispute. Licensee shall not represent that Curiosity Untamed LLC is responsible for investigating or resolving such disputes.
4. Rules of Conduct
Licensee agrees to comply with the following when accessing or using the Content:
(a) Restricted Topics and Political Advocacy. Licensee shall not use the Content for instruction, discussion, or activities involving sex, sexuality, gender, or pro-life/pro-choice issues. Licensee shall not use the Content for political advocacy, including, but not limited to, participation in parades, protests, rallies, or public support of or opposition to legislation, candidates, or political movements.
(b) Prohibited Substances. Licensee shall not allow smoking, illegal drugs, marijuana or alcohol in the presence of minors while using the Content, and shall not associate smoking, illegal drugs, marijuana or alcohol with Curiosity Untamed LLC, Frontier Girls, or Quest Clubs.
(c) Unlawful or Harmful Conduct. Licensee shall not use the Content or Website for any unlawful, fraudulent, abusive, infringing, or harmful purpose. Licensee must comply with the additional Website-use restrictions in Section 5.7. Violation of this Section 4 may result in suspension or termination of the License or Licensee’s account, at Licensor’s discretion.
5. Terms of Use
Section 5.1 Communications
Curiosity Untamed LLC may communicate with Licensee by email regarding Licensee’s account, Subscription, this Agreement, incorporated agreements and policies, and other administrative or transactional matters related to the services provided under the Subscription. Licensee is responsible for keeping the email address on file current. Unsubscribing from marketing or promotional communications does not opt Licensee out of transactional, administrative, or legal communications relating to Licensee’s account or Subscription. Notice sent to the email address on Licensee’s account is deemed received as provided in Section 12.3.
Section 5.2 Third-Party Websites
The Website may link to third-party websites for convenience only. Linking does not create an affiliation with or endorsement of those websites. Curiosity Untamed LLC does not control third-party websites or their content or privacy practices and is not responsible for them. Users access third-party websites at their own risk, and disputes regarding goods or services obtained there should be directed to the third party. To report a broken or objectionable link, contact Curiosity Untamed LLC at the notice address in Section 12.3.
Section 5.3 Accounts
Licensee must be 18 years or older to register for an account or obtain a Subscription. Minor Participants may not create or manage an account or use a Licensee’s login credentials. An adult account holder is responsible for managing any account through which Content is provided for use by a minor. Licensee must provide accurate and current registration information. Licensee is responsible for activity conducted through Licensee’s account within Licensee’s reasonable control and should promptly notify Curiosity Untamed LLC of known or suspected unauthorized account use.
Section 5.4 Passwords and Security
Login credentials, including usernames and passwords, are personal to the account holder, non-transferable, and may not be shared with another person. Licensees may not share account credentials with Participants, parents, family members, volunteers, co-leaders, instructors, or any other person as a means of providing access to Content. Volunteers, co-leaders, and other individuals authorized to assist a Group, Class, Club, or Troop must use their own Complimentary Leader Membership or other account authorized by Licensor. Licensee is responsible for taking reasonable steps to maintain the confidentiality of account credentials and for activity occurring through the account within Licensee’s reasonable control. Licensee agrees to promptly notify Curiosity Untamed LLC of any unauthorized use or other security breach involving the account.
Section 5.5 Limited Use; Restricted Use
Licensee may use the Content only as permitted under the applicable Subscription and this Agreement, and only while the Subscription remains active, unless otherwise authorized in writing by Curiosity Untamed LLC. Licensee may not alter or present the Content in a manner that falsely suggests that the Content was created, published, sponsored, or endorsed by another person or entity. Licensee may not frame the Website or hyperlink directly to password-protected Content without Licensor’s prior written permission. Licensee may not remove, obscure, or alter any copyright, trademark, attribution, or other proprietary notice appearing on or within the Content.
Content may be printed or downloaded only within the scope of Licensee’s Membership type. For a Group/Class Membership, Frontier Girls Troop Membership, or Quest Club Membership, copies of Content may be provided to enrolled Participants only when the Content relates to a badge or activity currently being taught or actively worked on by that Group, Class, Club, or Troop and only as part of that group instruction. Those Memberships do not grant Participants general or independent access to Content outside the group setting; however, materials specifically provided for a badge or activity currently being taught or actively worked on may be used by an enrolled Participant at home as part of that group instruction. Content for badges or activities not being taught or actively worked on by the Group, Class, Club, or Troop may not be distributed to Participants. Content may not be posted publicly, distributed outside the scope of the applicable Membership, or accessed by sharing account credentials. When a Subscription expires, all use of Content must cease and any downloaded or printed copies must be destroyed or deleted.
Section 5.6 User Comments, Feedback, Submissions, and Postings
By submitting content to Curiosity Untamed LLC — including comments, feedback, ideas, or designs (but excluding photographs, video, film, or vocal recordings, which are addressed in Section 5.8) — the User grants Curiosity Untamed LLC a perpetual, worldwide, royalty-free, non-exclusive license to use, display, reproduce, or distribute that content for promotional or educational purposes in any media. The User affirms that they own or have secured all rights necessary to make the submission and that the submission does not infringe any third party’s rights. Curiosity Untamed LLC is not obligated to use any submission and is not liable for similarities that may appear in its future business operations. Opinions expressed in User submissions are the User’s own and do not reflect the views of Curiosity Untamed LLC.
Section 5.7 Unlawful Activities
Users must comply with all applicable laws and regulations in connection with use of the Website, Content, and any Submissions. Users may not interfere with another party’s use and enjoyment of the Website; post content that is unlawful, threatening, abusive, harassing, defamatory, invasive of privacy, or harmful to minors; impersonate any person or entity; disclose another person’s personal information without consent; infringe any intellectual property or proprietary right; or disguise the origin of content through misleading identifiers.
Users may not contact anyone who has asked not to be contacted; make unsolicited commercial contact with other Users; collect other Users’ personal data for commercial or unlawful purposes; transmit harmful code to the Website’s servers; reverse-engineer or decompile the Website; use the Website in a manner that could damage, disable, overburden, or impair it; or access the Website through unauthorized means. Violations may result in suspension or termination of access and may give rise to civil or criminal liability where applicable.
Section 5.8 Photograph, Video, Film, or Vocal Recording Release
By submitting a photograph, video, film, or vocal recording to Curiosity Untamed LLC, or posting one to a forum moderated by Curiosity Untamed LLC or its authorized representatives, the User grants Curiosity Untamed LLC a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, and display that media for promotional or educational purposes, including on Curiosity Untamed LLC’s websites, in publications, and on social media, subject to the following:
The person submitting the media affirms that they are either (i) the parent or legal guardian of any minor depicted, or (ii) have obtained the express permission of that minor’s parent or legal guardian to submit the media for these purposes, and can provide confirmation of that permission to Curiosity Untamed LLC on request. This release is given without expectation of compensation. It remains in effect until revoked in writing; revocation applies to future use only and does not require removal of previously published material. Curiosity Untamed LLC may request a signed release form for any submitted media at its discretion, and reserves the right to decline to use, or to remove from future use, any media for which adequate parental permission cannot be confirmed.
Section 5.9 Community Events
Any event sponsored or organized by Licensee that is open to the public — including community service projects, fundraising, recruitment, or educational events — must include the following disclaimer in all advertising, signage, publicity, and marketing: “This event is independently organized and operated by [Licensee and Group/Class/Troop/Club name and assigned tracking number, if applicable]. It is not organized, operated, sponsored, or supervised by Curiosity Untamed LLC, owner of the Frontier Girls and Quest Clubs programs.”
Upon request, Licensee shall provide representative samples of advertising or promotional materials using Curiosity Untamed LLC’s Trademarks and shall make reasonable changes necessary to comply with the Trademark and Brand Guidelines.
Section 5.10 Technology and Service Disclaimer
Curiosity Untamed LLC makes reasonable efforts to maintain the availability and functionality of the Website and Content but does not guarantee uninterrupted, secure, or error-free access. The Website and Content are provided “as available.” Curiosity Untamed LLC is not liable for interruptions, delays, errors, or data loss caused by acts of God, internet or communications outages, hosting failures, third-party service providers, unauthorized access, or other causes beyond its reasonable control. Access may be suspended for maintenance, updates, or circumstances beyond Curiosity Untamed LLC’s control.
Section 5.11 Data Security
No method of internet transmission or electronic storage is completely secure, and Curiosity Untamed LLC does not warrant absolute security of transmitted or stored information. Users acknowledge the inherent risks of transmitting information over the internet. Curiosity Untamed LLC is not responsible for unauthorized access, disclosure, alteration, or destruction of data except to the extent liability is imposed by applicable law. Licensees are responsible for maintaining the confidentiality of their account credentials.
Section 5.12 International Users
The Website and Content are controlled and operated from the United States. Users who access the Website or Content from outside the United States do so voluntarily and are responsible for compliance with laws applicable to their use. Curiosity Untamed LLC makes no representation that the Website or Content is appropriate or available for use in every jurisdiction.
6. Grant of License; Sublicensing
Section 6.1 Grant of Limited License
Licensor grants Licensee a non-exclusive, revocable limited license to use the Content and associated program curriculum in youth or adult programming for the Term, solely as set forth in this Agreement and the applicable Subscription. Licensor may terminate this License for breach of this Agreement, including the Rules of Conduct in Section 4, or for failure to maintain an active Subscription, as provided in Section 7. Upon termination, Licensee must cease all use of the Content and destroy or delete all downloaded or printed materials.
Section 6.2 Sublicensing
Licensee shall not sublicense its rights under this Agreement without Licensor’s prior written consent, which may be withheld in Licensor’s discretion. An attempted sublicense in violation of this section terminates this Agreement automatically. Licensee is responsible for Licensor’s reasonable costs, including attorneys’ fees, incurred as a result of such a breach.
Section 6.3 Reservation of Rights
All rights not expressly granted to Licensee in this Agreement are reserved to Licensor.
Section 6.4 Ownership
Licensee acknowledges that, as between the Parties, Curiosity Untamed LLC is the sole owner of all right, title, and interest in the Content. Licensee will not sell, reproduce, or use the Content in the production or sale of any materials or services, and will not modify the Content without Curiosity Untamed LLC’s prior written approval. Licensee shall not challenge, contest, or dispute Licensor’s ownership of or rights in the Content or associated goodwill. Any goodwill in the Content arising from Licensee’s use inures solely to Licensor’s benefit. To the extent Licensee is deemed to own any rights in the Content, Licensee irrevocably assigns those rights, and any associated goodwill, to Licensor without further consideration.
Section 6.5 Supplemental Policies and Guidelines
Licensor may publish supplemental policies and guidelines, including a Trademark and Brand Usage Guidelines document, a Copyright and Curriculum Usage Policy, and a Privacy Notice, describing permitted and restricted uses of the Trademarks and Content and explaining how personal information is handled. These policies and guidelines are incorporated into this Agreement by reference. Licensor may update them from time to time. Material changes to an incorporated policy or guideline are subject to the notice and acceptance procedures in the Modifications provision at the beginning of this Agreement, including acceptance by continued use unless affirmative re-acceptance is required by Licensor or applicable law. Non-material changes may be made as provided in that provision.
7. Term and Termination
Section 7.1 Term
This Agreement commences on the date Licensee first accepts this Agreement or an earlier version of this Agreement under the Acceptance of Terms provision above and continues until Licensee’s account is terminated and Licensee ceases use of the Website and Content.
Section 7.2 Termination for Convenience
Either Party may terminate this Agreement on thirty (30) days’ written notice to the other Party. If Licensor terminates for convenience under this Section 7.2, Licensor will refund Licensee any prepaid, unused Subscription fees for the remainder of the current Subscription term on a pro-rated basis, less payment gateway fees. Upon termination, Licensee shall cease all use of the Content and return or destroy all program materials, at Licensee’s expense.
Section 7.3 Termination for Breach
Licensor may terminate this Agreement immediately on written notice if Licensee violates or attempts to violate any provision of this Agreement.
Section 7.4 Effect of Termination
Upon termination of this Agreement or the applicable Subscription, Licensee shall immediately cease all use of the Content and shall ensure that individuals authorized to use the Content under Licensee’s Subscription also cease such use. Licensee shall destroy or delete all downloaded, printed, or otherwise reproduced copies of the Content and shall cease distributing any materials containing the Content. Upon termination, Licensee shall cease any use of Curiosity Untamed LLC’s Trademarks that were authorized by the terminated Subscription, including use in names, domain names, and social media identifiers.
8. Fundraising
Section 8.1 Disclaimer
All fundraising activity by Licensee — including advertising, signage, publicity, and marketing — must include the following disclaimer: “This fundraiser is independently organized and operated by [name of Licensee or Group/Class/Troop/Club name and assigned tracking number, if applicable]. It is not organized, operated, sponsored, or supervised by Curiosity Untamed LLC, owner of the Frontier Girls and Quest Clubs programs.”
Section 8.2 Commercial Use
Licensee may not use the Content as the basis of an income-producing program, class, service, or business. This restriction does not prohibit a school, homeschool co-op, or other organization from using the Content as part of its educational programming or from compensating employees or instructors who use the Content in the course of providing that programming.
Section 8.3 Fundraising Compliance
Licensee is solely responsible for compliance with all applicable federal, state, and local laws, regulations, and ordinances relating to fundraising, charitable solicitation, nonprofit status, and tax reporting. Curiosity Untamed LLC does not provide tax, legal, or accounting advice and is not responsible for Licensee’s failure to comply with applicable requirements.
9. Contracts
Licensee may not enter into any contract or legal agreement on behalf of Curiosity Untamed LLC, Frontier Girls, or Quest Clubs, or represent that it has authority to bind Curiosity Untamed LLC. All contracts related to Licensee’s activities — including, but not limited to, rental, utility, fundraising, or financial agreements — must be entered into by Licensee or the independently operated organization responsible for the activity, and not by or on behalf of Curiosity Untamed LLC.
10. Indemnification
Section 10.1 Indemnification by Licensee
Licensee will defend, indemnify, and hold harmless Licensor, its affiliates, and their respective directors, officers, employees, agents, and representatives from claims, losses, injuries, liabilities, damages, awards, settlements, judgments, fees, costs, or expenses, including reasonable attorneys’ fees and costs of suit, arising out of (i) Licensee’s breach of this Agreement; (ii) Licensee’s activities, conduct, or operation of any Group, Class, Club, Troop, business, or other program using the Content; or (iii) Licensee’s unauthorized use of the Content or infringement of a third party’s rights, in each case except to the extent arising from Licensor’s own gross negligence or willful misconduct. This provision survives termination of this Agreement.
Section 10.2 Indemnification Procedure
Licensor shall notify Licensee in writing as soon as practicable of any indemnifiable claim. A delay in notice does not relieve Licensee of its obligations except to the extent Licensee is prejudiced by the delay. Licensor shall reasonably cooperate in the defense at Licensee’s expense. Licensee shall control the defense but may not settle a claim without Licensor’s prior written consent, not to be unreasonably withheld. Licensor may participate in the defense with its own counsel at its own expense.
11. Representations and Warranties; Limitations
Section 11.1 Disclaimer of Warranties
The Content is provided for informational and educational purposes and does not substitute for professional guidance. Licensor does not guarantee the accuracy or completeness of the Content and may change it at any time without notice. The Content does not account for every User’s specific circumstances and does not constitute legal, safety, business, or other professional advice. Users are responsible for determining whether the Content is appropriate for their circumstances and activities.
TO THE FULLEST EXTENT PERMITTED BY LAW, LICENSOR MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THIS AGREEMENT OR THE CONTENT, AND DISCLAIMS ALL SUCH WARRANTIES, INCLUDING TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. USE OF THE CONTENT IS ON AN “AS-IS” BASIS.
Section 11.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LICENSOR AND THE LICENSOR PARTIES SHALL NOT BE LIABLE TO LICENSEE FOR SPECIAL, INDIRECT, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR INCIDENTAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION DOES NOT APPLY TO LICENSOR’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OR TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.
12. Miscellaneous
Section 12.1 Entire Agreement
This Agreement, together with any agreements, licenses, and policies expressly incorporated into it by reference, constitutes the entire agreement between the Parties concerning its subject matter and supersedes all prior or contemporaneous agreements, understandings, and representations concerning that subject matter.
Section 12.2 Assignment
Except as expressly permitted under the applicable Membership Subscription, Licensee may not assign or transfer this Agreement or its license to use the Content without Licensor’s prior written consent. Any attempted assignment or transfer not permitted under this Agreement is void. Licensor may assign or transfer its rights and obligations under this Agreement.
Section 12.3 Notice
Except where applicable law requires otherwise, notices from Licensor to Licensee will be sent by email to the email address associated with Licensee’s Website account and are deemed given when sent, provided Licensor does not receive notice that the email was undeliverable. Licensee is responsible for keeping the email address associated with the account current.
Notices to Licensor may be sent by email to info@curiosityuntamed.com or by U.S. mail to Curiosity Untamed LLC, 20845 Gregory Lane, Redding, California 96003, Attention: Customer Solutions, and are deemed given when received by Licensor.
Section 12.4 No Waiver; Cumulative Remedies
A Party’s failure or delay in enforcing any provision of this Agreement does not waive its right to enforce that provision later. Rights and remedies under this Agreement are cumulative and do not exclude any rights or remedies available under applicable law.
Section 12.5 Section Headings
Section headings are for convenience only and do not affect interpretation of this Agreement.
Section 12.6 Severability
A provision of this Agreement that is prohibited or unenforceable in a jurisdiction is ineffective in that jurisdiction to the extent of the prohibition or unenforceability, without invalidating the remaining provisions or affecting the provision’s validity elsewhere. Licensor may replace an invalid or unenforceable provision with a valid provision of similar intent and economic effect.
Section 12.7 Governing Law
This Agreement and the rights and obligations of the Parties are governed by the law of the State of California. Each Party irrevocably submits to the exclusive jurisdiction of the courts of the State of California, and the United States District Court for the applicable district within California, for any action relating to this Agreement, and to venue in those courts, except as otherwise required by the arbitration provision in Section 12.8.
Section 12.8 Dispute Resolution; Arbitration; Class Action Waiver
If a dispute arises, Licensee shall first contact Curiosity Untamed LLC Customer Support at 1-530-524-8799 or info@curiosityuntamed.com and make a good-faith effort to resolve the dispute informally.
If the dispute is not resolved, any dispute arising out of or relating to this Agreement shall be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under the AAA rules applicable to the dispute. The location and manner of any hearing shall be determined in accordance with the applicable AAA rules. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
To the fullest extent permitted by applicable law, arbitration shall proceed on an individual basis only and not as a class or consolidated action. Licensee waives the right to participate in class arbitration or a class action with respect to disputes subject to arbitration. By agreeing to arbitration, Licensor and Licensee understand that disputes subject to arbitration will be decided by an arbitrator rather than by a judge or jury.
This arbitration provision applies only to a Licensee who has affirmatively accepted this Agreement or an earlier version of this Agreement and thereafter becomes subject to this provision in accordance with the Modifications provision above.
Section 12.9 Survival
Any provision of this Agreement that contemplates performance or rights and obligations after termination survives termination and remains binding on the applicable Party, subject to any limitations expressly set forth in this Agreement.
